The Role Responsibilities
To promote, lead and manage the culture and practice of legal with the letter and spirit of all applicable legal and regulatory requirements and ethical standards in the conduct of the Private Banking business and Wealth Management business in UK and Jersey, so as to protect and enhance the reputation of the Bank.
To advise and promote best practices and company policies, as aligned to the UK and Jersey Regulators, the region, and the cross-border implications across various booking centres.
To be responsible for legal advice, transactional support and issues relevant to the Private Bank and Wealth Management businesses in UK and Jersey with particular focus on matters relating to structured products and derivatives.
As an independent second line risk control function, execute the relevant aspects of the Legal framework through robust independent risk control and the provision of specialist advice and constructive challenge in a manner proportionate to the nature, scale and complexity of the Group's business.
Proactively support and challenge the London PvB and WM businesses and functions to exhibit appropriate conduct, comply with legal and regulatory requirements and strive to achieve fair outcome for the Group's clients.
Evaluate the effectiveness of the London PvB and WM's Legal efforts.
Maintain constructive and effective relationships with Business Head/Business Chief Operating Officer, and the Regional Head of WM, AME and Europe.
Maintain independence, deliver timely responses, and timely escalation of risks and issues where they feel risk management tolerance of the firm are exceeded.
Support and implement the vision, strategy, direction and leadership for Private Banking & Wealth Management Legal team in UK and Jersey, consistent with Head, Legal, Private Banking & Wealth Management's vision and strategy for the Legal function and in support of the Bank's strategic direction and growth aspirations.
Lead in the proactive and strategic identification of material legal and regulatory risks in the business. Influence stakeholders to improve the management of legal and regulatory risk relevant for the UK and Jersey PvB and WM businesses.
Build and maintain an effective and constructive relationship with all key business and functional stakeholders that is based on trust, capability and integrity, providing timely, responsive and quality legal advice and guidance to enable the business and functions to meet/ achieve their strategic tactical objectives.
Provide assistance with legal advice, briefings, recommendations and reports on material legal risks and issues to the head of legal and/ or to the business, country and functional stakeholders.
Provide robust challenge to senior management and all relevant business stakeholders where activities are outside risk tolerance/ appetite, escalating as necessary, until appropriate oversight and ownership is achieved including actions and plans to address any remedial action needed to come back within risk tolerance/ appetite.
Work closely with the business to provide timely legal advice to ensure compliance with all relevant laws and regulations relevant to the PvB and WM businesses in UK and Jersey.
Provide support in problem-solving and crisis management over critical issues that have a legal or regulatory impact on the Private Bank's and WM's business/ operations.
Regular and diarised catch ups with the head of Legal WM/ Private Banking UK/Jersey.
Raise awareness of, and addresses, legal and regulatory risks and issues
Our Ideal Candidate
Qualified lawyer (ideally with experience in advising a WM and/ or Private Bank business)
Previous experience of working within a regulated environment (ideally with retail clients)
Knowledge and experience of (some or all of) the products offered by WM and in particular structured products and derivatives
Thorough knowledge of financial services, banking and other laws and regulations in UK and Jersey Strong analytical and innovative legal skills
Good communication and interpersonal skills, especially with business people
Good judgement enabling the provision of sound advice in difficult areas of law and practice
An inquisitive approach to practices, procedures and specific transactions
Independence and robustness
Personal authority, integrity and ethics
Ability to work under pressure, meet deadlines and work effectively with business units
Proficiency in English, written and spoken
Good use of the pack Office (Word, Excel, Power Point, Outlook) and good typing skills.
