Assist the Head of PBRS Regulatory Compliance in carrying out the mandate of Regulatory Compliance;
Provide clear, concise and timely advice to PBRS' senior management and employees on all applicable laws, regulations, Global Standards, FIM requirements and other policies/procedures applicable to their activities;
Provide stewardship to the first line of defence of PBRS on key regulatory compliance risks, including those raised by local and foreign regulatory developments, raised by their ongoing activities, transformation initiatives or other projects;
Contribute significantly to the visibility of the Regulatory Compliance function by regular interactions with other departments and functions, active engagement and participation through various forums, and by contributing to training, broadcasts and other communication initiatives of important regulatory compliance topics;
Assist the Head in ensuring that any GPB or HSBC Group initiatives, and specifically those concerning compliance, legal, and risk, are properly addressed and rolled out within PBRS.
Assess all regulatory compliance risks Client and balance sheet activities of PBRS, with a strong focus on the distribution of financial products and services to Clients;
Ensure management awareness of those Risks and provide leadership and stewardship in ensuring that such risks are addressed by the first line of defence by appropriate mitigation measures;
Ensure that Staff are adequately advised, trained and informed on their conduct duties towards Clients, PBRS, and the market;
Contribute to all BAU activities of PBRS Regulatory Compliance;
Advise PBRS staff of any cross-border restrictions applicable to their activities;
Advise PBRS on how to manage privacy, banking secrecy and data protection matters;
Handle inquiries from regulatory Authorities;
Ensure that PBRS performs a proper review and establishes adequate oversight over any foreign activity, such as third party introducers, representative offices, branches, subsidiaries, and foreign licensed activities of PBRS;
Provide timely advice to PBRS Legal on any contractual matters requiring Regulatory Compliance input;
Participate actively in any de-risking or risk mitigating activity of PBRS, such as review of existing commercial relationships with external counterparties and asset managers;
Assist the PBRS Head of Compliance with any other task as required.
Regulatory Compliance Material
Review and update as required all guidelines and directives of Regulatory Compliance, or related to Regulatory Compliance matters;
Ensure that all relevant Regulatory Compliance material is appropriately communicated to Staff, and included in the Regulatory Compliance inet;
Identify training needs and deliver compliance training as required;
Develop and maintain tools and initiatives for initial and on-going compliance training;
Provide clear advice to PBRS employees with respect to existing and new regulatory requirements as well as to the Bank's internal rules and those issued by the HSBC Group;
Advise PBRS on all cross-border restrictions affecting its activities;
Liaise with GPB Compliance, and specifically GPB Head of Cross-Border, on all cross-border issues;
Reporting & Management Information
Contribute to regular Compliance and Management Information reports;
Report all material compliance issues or significant breaches on a timely basis;
Provide appropriate input into any activity reporting to all PBRS committees as required;
Provide any assistance required by the Head of PBRS Regulatory Compliance in regards to any specific duties of reporting, governance, or certifications which may be required of PBRS Regulatory Compliance;
Knowledge & Experience / Qualifications
Degree in law or equivalent university degree
Detailed understanding of Private Banking business, products, services and regulatory matters and initiatives affecting the industry
Strong Knowledge Swiss law and regulations, FINMA Circulars, FIMs, applicable foreign law, and of all internal guidelines and policies of the HSBC Group, GPB, and PBRS
Solid and proven practical experience gained in the financial/private banking industry or legal/compliance area of at least 8-10 years
Significant understanding of all financial products
Outstanding communication skills
Strong analytical skills
Service-oriented attitude with ability to provide practical advice and solutions to meet business needs
Able to work independently and autonomously, while also being an excellent team player and a leader
Ability to meet tight deadlines and work under pressure
Fluency in English, both written and spoken. Proficiency in French and/or German is an advantage
Computer literacy required, with skills in all MS software (Word, Powerpoint, and Excel).
